The following ordinance was submitted for introduction by Louis Richard, in regular session convened on July 22, 2008.
PROPOSED ORDINANCE
The following Ordinance, having been previously introduced and published, was offered for final adoption by Matt Matherne, seconded by Phillip Gouaux.
ORDINANCE NO. 4360
AN ORDINANCE RESCINDING ORDINANCE NO. 4120 AND ENACTING SUB-CHAPTER Z OF CHAPTER 24 OF THE CODE OF ORDINANCES OF THE PARISH OF LAFOURCHE AS IT PERTAINS TO THE CREATION OF THE LAFOURCHE PARISH HEROES’ MONUMENT COMMISSION; TO PROVIDE FOR ITS CREATION, TERRITORIAL LIMITS, MEMBERSHIP, TERMS OF OFFICE, COMPENSATION AND PURPOSE.
BE IT ORDAINED, by the Lafourche Parish Council, convened in regular session on August 12, 2008, whereby rescinding Ordinance 4120 and enacting Sub-Chapter Z of Chapter 24 of the Code of Ordinances of the Parish of Lafourche to read as follows:
SECTION 1. Creation
Pursuant to the provisions of Article VI, Sections 5 and 15 of the Constitution of the State of Louisiana of 1974, and Article III of the Home Rule Charter of the Parish of Lafourche, the Heroes Monument Commission is hereby created.
SECTION 2. Territorial Limits
The Heroes’ Monument Board’s boundaries shall be inclusive to the entire Parish of Lafourche, State of Louisiana, excluding the territory bounded by Policy Jury Ward No. 10 of the Parish of Lafourche, State of Louisiana, as the boundaries of Ward 10 are presently constituted.
SECTION 3. Membership, Terms, Compensation
A. The Heroes’ Monument Commission shall be comprised of nine (9) members, all of which shall be electors domiciled outside of Ward 10; and five (5) of which shall be Honorably Discharged Veterans of a Branch of the U. S. Armed Forces; two (2) members shall have been employed as a Commission Police Officer for a minimum of five years; and two (2) members shall have served as a fireman for a minimum of five years.
B. The initial members of the Heroes’ Monument Commission who shall serve without compensation, shall be appointed by the Parish Governing Authority or authorities for a term of four (4) years.
Terms shall be as follows:
The nine commissioners initially appointed shall be appointed for terms of one, two, three, four, and five years, respectively;
Commissioners (A and B) for one year
Commissioners (C and D) for two years
Commissioners (E and F) for three years
Commissioners (G and H) for four years
Commissioner (I) for five years
They shall serve until their successors shall have been appointed and qualified. All Commissioners thereafter appointed at the expiration of such respective terms shall be appointed by the Parish Governing Authority or authorities for terms of four years. Any vacancy which otherwise occurs shall be filled by appointment of the Parish Governing Authority or authorities for the unexpired term. In making such appointments the requirements that the Board of Commissioners shall include at least one qualified voter and affiliate of each classification which has been included in the Commission by consent of its Governing Authority shall apply.
C. The commissioners shall elect from their own members a president and a secretary/treasurer whose respective duties shall be prescribed by the board of commissioners.
The board of commissioners shall designate the time and select the place of holding their regular monthly meetings and they may be convened at any time upon the call of the president or upon the call of two of the commissioners. A majority of the members of the board of commissioners shall constitute a quorum and all actions or resolutions of the board of commissioners must be approved by the affirmative vote of not less than a majority of all members of the board of commissioners.
D. The Heroes’ Monument Commission shall submit to the Council Clerk’s office a yearly budget, a yearly audit, all meeting agendas, all minutes of meetings and a written progress report which shall contain their current operating budget and their accomplishments and activities. The Board shall also present an annual oral report to the Lafourche Parish Council.
SECTION 4. Purpose
The purpose of the Heroes’ Monument Commission shall be to:
(a) Help maintain the many monuments and memorials currently dedicated to Policemen, Firefighters, and Veterans.
(b) Help organize celebrations recognizing heroes such as Veteran’s Day Parades, Memorial Day observations, etc.
(c) Evaluate the need for additional activities and monuments which commend Policemen, Firefighters, and Veterans.
(d) Grant approval to individuals and/or groups wishing to modify any existing public monuments.
SECTION 5. From and after the effective date of this Ordinance, the Heroes’ Monument Commission appointed by the Lafourche Parish Council shall assume the duties of their respective offices; however, that prior to (a) the adoption of an annual budget, (b) the purchase, sale or encumbrance of immovable property, (c) submitting to the voters a new tax or proposed renewal or increase in existing ad valorem taxes, and (d) the incurring of debt, the Heroes’ Monument Commission shall obtain the approval of the Lafourche Parish Council.
SECTION 6. All Ordinances or parts of Ordinances by the Lafourche Parish Council conflicting with or inconsistent with the provisions of these regulations are hereby repealed.
SECTION 7. This Ordinance shall be published in the Official Journal of the Lafourche Parish Council in the manner provided by law.
SECTION 8. This Ordinance, having been submitted in writing, having been read and adopted by sections at a public meeting of said Council, was then submitted to an official vote as a whole, the vote thereon being as follows:

ABOUT THE COMMISSION:
The Lafourche Parish Heroes Monument Commission was formed to join with Concerned Veterans of Louisiana Inc. to bring respect to our heroes.
We needed a body of government to help us get the word out as to what we wanted to do. By being a commission for the Lafourche Parish Council, we can turn to the voting public to help pass a millage to help purchase the property (if and only if we cannot accomplish this with grants and donations).
This nine-member board will work in conjunction with the Lafourche Parish Council and Concerned Veterans of Louisiana Inc. to build Heroes Monument.
We ask everyone who qualifies to please purchase a tile as a Hero or a Supporter. Every dollar we collect counts!

I am founder and President of Concerned Veterans of LA. Inc.
I was a draftee. My number in the 1969 draft lottery was 6.
I served in Vietnam from June 1970 to May 1971. I came in at Cam Ron Bay and was tationed in Dian with the 223 S & S Company. My M. O. S. was 64 C 30, which was a heavy truck driver. I stayed there for 8 months.
The Army decided to use computers for the first time to put together an operation. I was airlifted from Dian and sent to Da Nang. From there we convoyed to Hill 881, Khe Sanh, South Vietnam, Jan 1971. I spent 2 months there with a P.O.L. Detachment, attached to Da Nang Support Command.
I came home on Memorial Day 1971.
(This is my Father, Edward "Sweet" Tabor. He is 89 years young and still collects a pay check for working.)

I was in L Troop, 3rd Platoon. Our base camp was in Xuan Loc.

My name is Robert Paul Harris Jr. After basic training at Fort Polk I was dispatched to Fort Lewis, Washington as a 42B10 (heavy-equipment mechanic) and ended up being a heavy equipment operator.
After 10 months training I was dispatched to the 9th infantry in Dong Tam, Vietnam as a PLL clerk. When the 9th transferred back to the states I elected to stay in country for my last 6 months of service because I hated state side duty!
I was then dispatched to just south of the DMZ in a place called LZ Nancy, which was later called Fire Base Nancy. I finely got the use my original 62B30 MOS with the 115th Engineers. I left South Vietnam on April 17, 1970, at a rank of Spec 4.

My name is John Waguespack; I am a native and resident of Thibodaux and a Thibodaux High School graduate. Upon graduating from Thibodaux High School and just before enlisting in the United State Air Force I was a active member of the Thibodaux Volunteer Fire Department - the Protector Fire Station.
I committed to serve in the United States Air Force on May 7, 1975, and was honorably discharged as an E4 Sgt from active duty July 20, 1979. I served out my reserve time until my final discharged date of July 20, 1981. While in the Air Force I served as an Electronic Warfare System Specialist until I was selected to participate in a new training program for fighter pilots of all branches. The Air Combat Maneuvering Instrumentation (Top Gun) as seen in the Tom Cruise movie was to help improve our fighter pilots in air combat situations.
I started my law enforcement career March 16, 1980 and have proudly served my community since. I served as a Nicholls State University Campus Policeman, an Assumption Parish Sheriff Deputy, and I am now serving as a Department of Public Safety Police Officer under the supervision of the Louisiana State Police.
